A class action lawsuit has been filed against Square Enix and Sony Computer Entertainment America for selling copies of Final Fantasy XIII that allegedly freeze and even break PlayStation 3 consoles.

The lawsuit, filed on June 2, 2010 by Daniel Wolf of San Diego, Calif., alleges Final Fantasy XIII has caused "severe and widespread damage" to Sony PS3 gaming systems since its release on March 9, 2010. The lawsuit states that, for many consumers playing Final Fantasy XIII, has "caused their PS3 consoles to freeze and become totally and permanently inoperable." Wolf said he purchased a copy of Final Fantasy XIII the day it was released, and when attempting to save his game, his PS3 became unresponsive and would no longer play any other media after restarting it.

"Both Defendants are eminently aware of the damage being cause by their defective products, and have chosen to do nothing about it," the lawsuit says.

The suit also alleges that both Sony and Square Enix blamed the issue on one another. Square Enix said the issue resulted from Sony's console, and Sony blamed the issue on a faulty Final Fantasy XIII game disc. Neither company allegedly offered to cover the cost of repairing PS3 consoles.

The class seeks more than $5 million in damages and other financial relief.

Square Enix has not responded to requests for comment at this time. Sony told IGN it does not comment on legal matters.

Well that's childish, blaming it on one another. What's going to end up happening? Nothing, unfortunately, cause they've both got sticks up their arses about doing nothing wrong.

THE 360 VERSION DOESN'T LOOK SO BAD NOW, DOES IT FANBOIS?! :awesome:

I wonder if the console changes might have caused this...the earlier consoles had more clearance perhaps...than the slimline consoles Sony is producing now.
Might have made more sense for Sony to have just replaced the guy's console and for Square to have given him another copy of the game and spared themselves the legal expense.

Personally I don't buy into it, this is the first time I've even heard of the problem. Even after it was released the only complaints I heard on the likes of GameFAQ was the actual content. And how is meant to "brick" the system if nothing is installed onto it? My PS3 just got the YLoD [again] a few hours whilst playing RDR, I think I'll sue Rockstar.

I think you could pull it off. :awesome:

So is this just one guy suing both companies for his PS3 broken, or a bunch of people suing together for the same reasons?

It seems like it's just this one guy with his lawyer claiming "100" people have complained about the issue. 100 out of about 4 and a half million PS3 copies of FFXIII :ffs:

Does he know these special 100 people? Because otherwise it's kinda pointless... Otherwise it's the movie 300 with nerds and pretty soon the result will be SE kicking this guy into a pit, screaming 'THIS IS JAPAAAAAAAAAAAAAAN!!!'

^^ Rofl.

One of my friends PS3 started freezing up, but that was before he got 13. He's had some trouble with his ps3 I dunno what the deal is with it... he does have a slim though so like ANGRYWOLF said maybe the slims have some unforseen problem with them.

I haven't had any problems with mine then again I do have one of the fat ones. XD

This wasn't caused by FFXIII.

It's all in his OWN Console.

I would know, my cousin's PS3 DID THE EXACT same thing that the lawsuit stated about the guy's PS3.

My cousin's ps3 just started freezing up in the middle when he was playing Call of Duty MW2 online. He turned it off, let it rest for like 1 hour and then the light became yellow.

It started again 5 minutes later after that, but once it got to reading the MW2 disc, it just shut down. And then that's it.

Since when does SE plan to kill any PS3 if they're trying to make money off their games.

This reminds me of that law suit someone filed against S-E about FFXI's obscure payments guidelines or something for that game - how'd that pan out? *rolls eyes*

Although if the game is legitimately causing this problem, then shame on S-E. My PS3 copy of FFXIII works fine though, so it doesn't seem like it's a a series of disc failures, just the odd one out of a batch unfortunately D=

lolwhut.

I wish I'd thought to file a lawsuit for the screen-tearing I had to endure. Or perhaps I should file a lawsuit for the ear-splitting soundtrack and voice acting?

The simple, logical answer to this is to get new copies of both the console and the game with no charge, which should be easy enough to do if the faults have happened through no fault of your own. Where the hell did this idiot get the idea of a lawsuit from? That is just plain greedy.

Trying to tackle two of the biggest, most popular companies around with something as petty as that is like trying to stop a thunderstorm by throwing stones at it. This will no doubt be the only time we hear of this lawsuit; it won't go anywhere.

A judge would even consider those as isolated exceptions. A lost cause if you ask me. I've played lots of games, I even remember Metal Gear Solid 4 (I am playing MGS4 right now ;)) which required an game installation every time you changed from one chapter to the next (or every two chapters). That game had tons of graphics, had more customizations (weapons, constantly changing camouflage, full scale battles, etc) than FFXIII, and it was hell of a lot better game. Or God of War III, the grand scale battles as well as the detailed environment and still no problems.

Honestly it sounds like a load of shite for me.:neomon:

I did some research on internet about the YellowLightofDeath ...
apparently if your ps3 gets too overheated it will literally ,meltdown... I guess Gaming Geeks cant play moderate..

However I bought my ps3 slim yesterday and put it on a carpet surface (which is HIGHLY unrecommended) and the damn thing got so hot it was unbelievable, and apparently the FAT ps3 is even worse.

So my advice , put it in a cool room, clear the surroundings of the ps3 and put it on a solid surface that cant accumulate too much heat.

Oh yeah and dont play too many hours straight lol.

Yup. Something goes wrong and you file a lawsuit. That's the way to go nowadays.

I don't really fully know much about this problem or who is to blame. It could have just been the guy's console, it could have been a faulty disc. It wouldn't be the first time I've heard about faulty copies of the game. Whether it's really true or not I'm not really sure. It could have just be coincidence. The guy could have simply looked at the correlation and label the game as being the cause.

But $5 million in damages? The problem's 'widespread'? Is it? I only read a couple of cases about it. It couldn't have been that 'widespread'. And SE and Sony aren't doing much to help either if they're arguing away. Perhaps SE deserves this lawsuit as a wake-up call to get their acts together.

You'd kinda think that if this really was such an issue, at least one FFF member would have reported back here with the same problem. It's not THAT small a forum after all :wacky: Only in America I guess... (Nothing against Americans, but you DO seem to have a high number of people making lunatic judicial claims ;) )
