Serious Is it legal to fire someone for being sick?

Technically no it aint legal, but it does happen for legal reasons. If your always sick, always not feeling well, always making excuses to not be there, then yeah they can fire you for "being sick". Reading your post it seems like you use to do this, or were doing this in the past.
Just saying if you seriously want to fight this, be prepared for them to look at everytime you called in sick how often you called in sick, all that jazz...
 
If you feel you have been fired for reasons that you shouldn't have, you should do two things.

1. Contact the BBB(Better Business Bureau). Explain your case and they will have an investigation made if they think you have a defense. This is free of charge.

2. File for Unemployment(if you can't get another job). If your statements are correct, then your previous employer will have no defense and lose the case. Of course, it takes like 4 months to get this done and when you start getting it, it's not even worth it. Use this for a worse case scenario.

But for my honest opinion, just move on.

Anyway I've got a new job lined up. The commut's a bit harsher than before and so far it's just part time, but it's better than nothing since my Unemployment Insurance ran out this week.

Best case scenario is you can actually get your job back. If not, it would probably prevent this from happening to someone else in the future. And there's no money to make but it won't cost money.

I have a friend that works for a call centre dealing with Apple products, and he was only allowed to take a certain amount of time a month off work sick, any longer and he could face having his employment terminated, I don't think that this is right, but depending on the contract giving to you by your employers. you may very well be able to lose your job for taking too much time off for being sick.

Feh I wouldn't want my job back. She'd make it a living hell beyond that, and after talking to someone else who's still there she's cut back hours, taken our staff meals, all because she's incredibly cheap.

I hardly ever took time off however, that's the thing. :hmmm: I think I called in, twice. And once when I had a fever and strep throat, I went in anyway.
 
i've called sick to work more than you :D

today was probably my 4th time - i took an antibiotic and it was like setting off a nuke in my stomach - i was out for the whole evening. only just returned to semi-normalcy, and i'm starving now.

peace of mind > shitty job. now you can get a better one!
 
To me it all sounds like an excuse to let you go. I'm not sure if ya'lls personality clash quite often, but maybe she didn't like your attitude. I'm not saying you had a bad attitude, but women act so cold towards each other, when they don't like certain things about each other.

Here in the states, most often times if you sign a contract you can get fired over the smallest things. Now if they denied you unemployment here in the states, that would be something totally different.
 
In a way, yes. The company NEEDS people to come to work. If someone is sick, and can't come to work for 2 days its understandable, and they'll normally keep their job. BUT if a person is sick a majority of the time and has to leave early continuously, then the company doesn't have much of a choice, their losing money.
 
Well, except this doesn't really sound like much of a company.

I'm supposing, no, this ain't legal. Well, if it were, there wouldn't be such a thing as 'sick leave'. Well, unless that boss takes it like how she says it - that it's a matter of attitude, and that there has been prior warnings.

Then that is legal; though honestly, I think like a few members before me have already posted, I think it is possible to take this to court and potentially win back something. Not so sure about the legal process and the chances though.
 
If you work with food, you shouldn't be anywhere near the place if you felt like you were gonna throw up, so if you were fired for being sick, you could use that loophole to sue her ass, for allowing sick people to work near food is a Health and Safety violation in itself. I get this all the time where I work, they care more about numbers than people and the food.

And you went into work with Strep Throat? Oh dear :|

Now that I think aboot it, I could have really made it difficult for her, and I don't know why I didn't. I had someone else as a reference from there, I didn't need her. And after she let go off the guy I replaced 7 months ago the same way, but the case was dropped.. the Labour Board would have really given it a second look at her as a person.

yeah the bases for termination is not the same by any means, it really depends on the job, the contract, and many other details. It is quite possible that they had every right to fire you legally and there may be nothing you can do about (wether its fair or not). I would make sure before you spend money on a lawyer and court, or you may end up screwing yourself on it.

Yeah there are many unfair people in the world, at least the positive thing is you can find a better job now.
 
This woman who was constantly sick and unable to do her job properly at my step dad's radiology firm was eventually let go because it was effecting the company. So yeah, what Ambassador said. It's reasonable to have to let go of someone who has an important enough job/is missing so much work that they're practically being paid for doing nothing. It depends on the employer though.
