Okay so i just figured out maybe 30 minutes ago that my bro was sent to jail, (not FFF jail -cough cough Damon)... Apparently He and his friend had stopped by Wal-Mart and my brother hadn't done anything but his friend is only 17 and had shoplifted without my brother realizing... and of course.... alarms went off, my brothers friend got off with just a pat on the wrist yet my brother got sent to jail, how unfair is that shit?
 
That is just epic bullshit fail. The justice system Has been failing these days. They only seem to notice the innocent ones and take them down. I hope evrything is worked out the right, lawful way
 
Did he have any previous charges? He can always appeal it, although it may take some time. I had one serious F**k up in life and spent a summer in jail :S. can't say it was easy. If it was his 1st offense he might be able to get out on parole early then get on probation shortly after, just make sure he doesn't mess up , cuz they WILL make your life a living hell. His buddy MUST have said something? like he was involved somehow? I just don't see how the offender would get off so light, but an accomplice gets jail time? was it backwards day by anychance? lol (sorry no lulz here)
 
Your brother has a bad friend ._. His friend probably blamed the whole thing on your brother and sweet talked the police or something >_>, this is totally unfair.
 
That sucks big time. =/ Why did they blame him though when the item was in the possession of your brother's friend? In any case, they can always check the security cameras and prove that your brother is not the guilty one here. Although...how old is your brother? Older than his 17-year-old friend? That's the only reason why I can think that the blame was put on him. Still, it's not right that your bro has to pay the price for it.
 
Wow that sucks. I'm amazed that the actual shoplifter got off scot-free but I guess that's the system for ya. My former boss was arrested for "armed robbery" despite being completely innocent, he was simply in the wrong place at the wrong time so the police arrested him (despite the fact that he apparently didn't match the description).

But besides getting a beating from the police, he left the station with no charge when the shopkeeper went to identify him. I will be very surprised if your brother gets in any serious trouble as a result of this. I'm sure the security camera's will be able to confirm his story if he was unaware that his friend was shoplifting and I doubt he will get into any real trouble.

But yeah, I hope everything goes well for your brother.
 
To sum up what I've said in previous threads about the law: I like the reasons behind the the laws we have, I just don't like the system used to carry them out. Needless to say its flawed. >_>

I do hope things get straightened out for your brother, an innocent man should never be behind bars.
 
That really sucks and has actually made me quite angry.

I can imagine he isn't going to be friend with this guy for very long after all this is all over.

Like others have said though, hopefully (well I'm guessing they will) view the CCTV, and get some proper evidence and find out that your brother doesn't deserve to be in jail when he is finally seen to have done nothing wrong.

What was the grounds on them arresting him? Was he found in possession of the stolen objects after his friend passed them to him or something? Or was he seen attempting to leave the scene with his friend and then it is assumed that he collaborated?
 
This sounds like another case of the system failing to me. Initially, I'd say that there has to be a reason they held your brother and not his friend. Like Mitsuki said, if your brother is 18, then he's not a minor anymore, unlike his 17 year old friend.

Well, I'm no law expert, but yes, I'd say your brother's getting the raw end of the deal here. I think another question in this matter would be the item that was shopplifted, what was it exactly? Is this something as trivial as a candy bar or was it something expensive like a piece of electronic hardware? If it's something relatively inexpensive, then your brother being in jail is even more ridiculous. Considering they let your brother's friend go, I'd say it must have been something inexpensive, otherwise they'd investigate both.

Now that I think more on it, I think the reason your brother is in jail is because his own friend threw him under the bus. If they were both talked to individually by the police, then it's possible his friend claimed that either he stole the item or that your brother somehow forced him to steal the item, either of which will land your brother in hot water. Either way, I think there is something to the story that you don't know about, and it's possible your brother doesn't know either.

To answer your question there, yes he did have previous charges, criminal mischief if im not mistaken, But i think that his probation ran out long time ago... not to experienced with the law...
 
Sounds like a way to shift the blame on someone else. I don't exactly see eye to eye with the law upholders... I've seen countless times where they just want to convict someone as fast as possible to cover their ass. In this case though, it seems as plain as day as to who is to blame, but maybe we don't have all the facts? I'm not calling your brother a liar, but something sounds a bit flawed here that he would just be convicted.

When dealing with the law though... there is always money even if you appeal you are going to be losing 1,000+ dollars because of it. Who knows if you are going to win, who knows what evidence makes the police think that he is to blame..

Sucks I know.
 
Yeah but what sucks even more is he has lost his job, ( he worked at Sam's Club) Since Sam's Club is a branch of Wal-Mart, and the money that he was supposed to get for college, is now gone.... Whole life pretty much, just got shot all to shit.
 
So... he went to jail because? I just... Kind of don't even see why if you're saying he went to jail just because his friend tried their own hand a five-finger discount.

But as Shu said; it just sounds like there's something missing from your story.
