A 14-year-old New Jersey girl has been accused of child pornography after posting nearly 30 explicit nude pictures of herself myspace.com _ charges that could force her to register as a sex offender if convicted.
The case comes as prosecutors nationwide pursue child pornography cases resulting from kids sending nude photos to one another over cell phones and e-mail. Legal experts, though, could not recall another case of a child porn charge resulting from a teen's posting to a social networking site.
My Space would not comment on the New Jersey investigation, but the company has a team that reviews its network for inappropriate images. The National Center for Missing and Exploited Children tipped off a state task force, which alerted the Passaic County Sheriff's Office.

The office investigated and discovered the Clifton resident had posted the "very explicit" photos of herself, sheriff's spokesman Bill Maer said Thursday.
"We consider this case a wake-up call to parents," Maer said. The girl posted the photos because "she wanted her boyfriend to see them," he said.
Investigators are looking at individuals who "knowingly" committed a crime, he said, declining to comment further because the case is still being investigated.
The teen, whose name has not been released because of her age, was arrested and charged with possession of child pornography and distribution of child pornography. She was released to her mother's custody.
If convicted of the distribution charge, she would be forced to register with the state as a sex offender under Megan's Law, said state Attorney General Anne Milgram. She also could face up to 17 years in jail, though such a stiff sentence is unlikely.
Some observers including the New Jersey mother behind the creation of Megan's Law are criticizing the trend of prosecuting teens who send racy text messages or post illicit photos of themselves.
Maureen Kanka whose daughter, Megan, became the law's namesake after she was raped and killed at age 7 in 1994 by a twice-convicted sex offender blasted authorities for charging the 14-year-old girl.
The teen needs help, not legal trouble, she said.
"This shouldn't fall under Megan's Law in any way, shape or form. She should have an intervention and counseling, because the only person she exploited was herself."
Called "sexting" when it's done by cell phone, teenagers' habit of sending sexually suggestive photos of themselves and others to one another is a nationwide problem that has confounded parents, school administrators and law enforcers.

Prosecutors in states including Pennsylvania, Connecticut, North Dakota, Ohio, Utah, Vermont, Virginia and Wisconsin have tried stop it by charging teens who send and receive the pictures.
In northeastern Pennsylvania, a prosecutor recently threatened to file child porn charges against three teenage girls who authorities say took racy cell-phone pictures that ended up on classmates' cell phones.
The MySpace case may be a first, though.
"I'm not sure I've seen a prosecution like this coming out of a social networking site," said Seth Kreimer, a constitutional law professor at the University of Pennsylvania.
Milgram, the attorney general, could not recall another such case in New Jersey. She cautioned parents to get on those sites and monitor what their kids are talking about and posting.
"Unfortunately, youth don't have the same judgment as adults," she said, "and often, adults don't have the same technical savvy as the youth."

I didn't read the whole thing but, basically, this chick posts nude pics of herself on Myspace. Like come on! she's only 14 -_-. I know they say she did it so her boyfriend could see 'em but I know I wouldn't have done it at the age of 14. It's sort of sad that her parent's don't watch over her. It's MYSPACE seriously. Lots of things can happen and being so young, it's extremely important to watch over them. It also goes into the 'Sexting' thing, which is like the same thing but over texting which is dumb too. >_>
It really frustrates me in a way. You'd think that their parent's would be responsible enough to lay down the law. I know not everyone's perfect but its common sense.

She'll get what she deserves if she gets convicted and she might just pick up a lesson or two. No teenager with the right set of mind would lower themselves to that level.I think it is outrageous enough that adult people post pornography of minors, but them actually posting nudity pictures of themselves on an international website? That's as stupid as it gets.

There is no such thing as a teenager with "the right set of mind." They're all in the throes of a hormone-induced rampaging insanity.

But really, I don't see this as that big of a deal. She's a teenager exploring her sexuality who just happens to have access to a technology that allows her to share her experience with millions of other people. And unfortunately, she lives in a country that has a ginormous stick shoved firmly up its ass when it comes to sex. Now, she should have been smart and sent them to her boyfriend privately and not broadcasted them all over the internet, but then, teenagers are dumb. And don't blame the parents. This could be done in a matter of minutes with the door to her room closed. If the boyfriend is of a similar age (13-16), I don't see the harm. If the boyfriend is 25 and requested/demanded the pics, lock his ass up.

Otherwise, assuming a compatible age, explain to me who the victim of this "crime" is?

And the human mind isn't fully evolved before the age of 24-25, so what? She should be in junior high by that age and most cerainly be capable to separate right from wrong to a certain degree. And they learn about sexuality around the age of 12-13, at least they do here.

You don't see what's the big deal? Put yourself in her parents position. Would you like seeing naked pictures of your daughter on the internet? She is fourteen, what can't possible be a big deal about that? Or are you one of those who take advantage of these things?

Sure, but to what degree? That's part of what being a teenager is, making mistakes and learning from them. Obviously some are bigger than others, but I don't think she should be crucified for this.

Of course not, but that's not the point. If my daughter did, I wouldn't press charges against her. Would you against yours?

No. If a 14 year old takes a naked picture of herself and sends it to her 14 year old boyfriend, is it illegal? Yes. Why? What's the difference?

It's a victimeless crime. Her parents may think that their daughter is a slut, but they don't own her. Also when both participants are under the age of consent, the police hardly ever prosecute unless egged on by the parents. Used to happen here a lot in the 50s-70s if the boyfriend was black.

Are you sure? Because I'm pretty sure it's 16. And are you sure NJ doesn't have Romeo and Juliet laws? And nowhere in the world is the age restriction higher than 18, excepting those countries where sex outside of marriage is outrightly illegal. So brush up on your age of consent laws.

People seeing a 14 year old's explicit pictures is not going to scar them for life.

In some countries they would kick her out of the house and leave her for dead. In Kazhakstan they would have stoned her at the worst. I don't live there, but different countries, different rules. You can't really tell how people would react around the world seeing those images.

But she's not in those countries, and therefore is not beholden to their rules. And if she did live there, I would argue that the law is in the wrong, not her.
 
I don't think the girl should be labeled a sex offender for posting nude pictures of herself, although I do feel that some sort of punishment is warranted. The bottom line is that she is 14, and should not be partaking in such an activity, but to somehow say that she is a distributor of child pornography is an over simplification of the law, because she is in fact a minor, and therefore by law incapable of making consensual sexual decisions on her own. It has been determined in most states that a person under the age of 17 cannot legally consent to having sexual intercourse (even if they themselves do personally consent to such an action, they are not legally allowed to do so). So by law, how could they consent to legally posting nude pictures of their own person, when they are a minor, and are incapable (by law) of consenting to sex? It makes no sense.

These days with pornography so easily available it's pretty easy for teenagers to get ideas. There were a few cases in my high school when things like this happened, so it's not as uncommon as you think. This kid is at that age of sexual experimentation and she happened to make a mistake.

If they are good parents they should stand by her, can you imagine how embarrassing all this attention would be for the girl. The parents aren't in a position to cry about this.

Personally I think the embarrassment of knowing that your parents have seen the pictures is enough punishment by itself. The bottom line is that she is 14 and bound to make some mistakes especially when it comes to sex.

Who the hell is she offending? Herself? Then that's her own damn fault and it certainly didn't hurt anyone other than herself. She will soon realise that in the long run.

It states that she can not be named because of her age...then why the hell are they even considering charging her as if she were of legal age?

The most that should be done is for her to get counseling. This issue is not serious. It's happening everywhere. To have sex at that age is more of a worry to me than just posting senseless nude pictures on the internet.

The parents can not always be the ones to blame either. They do their best and they can't be watching you every second of the day. She could have gone to the bathroom and taken those photos for all we know. What parent is going to follow their child into the bathroom?

They aren't expecting their child to do anything other than go to do their business. Kids are sneaky little shits and they will get away with just about everything these days because of the technology available. I agree that parents need to monitor their childrens use of technology but they can only do so much.

At the end of the day the parents have done the best they can do and if the child decides to screw it up then there will be consequences. However, the consequences this time around are far too extreme and this whole issue should have never gone to the media.

Why don't these people spend time looking for the real criminals out there. Such as murderers and REAL child pornographers?

The whole things stupid i think. I mean goin on the sex offender reistra for posting pictures of yourself :lol: its just ridiculous. It sounds like one of these cases that the meida will fuss over for a few days but it will blow over because really, who actually cares except maybe the parents? I very much doubt she will be prosecuted or put on the sex offenders reigister. Im sure the girl in question is probadly embarassed enough by now, seems a good enough punishment to me =/
 
Eh, I'm not sure what the results of her actions will be... but I definitely don't support her doing this. Not only does it demean herself, but it also encourages pedophilia, shows pornography to minors, shows pornography of minors... it's not a good list. I'd think counseling and community service would be an appropriate punishment... but if they're trying to make an example of her, maybe something more severe would be more fitting.
 
Thats shocking, like someone has already said; why lower your level to that?? If I would be her parent I would feel so disgusted at her and demand to know what was going through her immature mind!

She put herself at risk doing stupid things like that and it sets her up for life as a whore and a sex offender. That decision to take those photos has ruined her future as Im sure no college or university will look twice at her.

They were considering putting her on the sex offenders register, they haven't yet.
Also I doubt as to whether taking photos of herself will make her end up on a street corner, that seems a slight over-exaggeration if I may say so.
 
Hey, she could be the smartest girl when it comes to homework, but her common sense is crap. What person posts up nude photos of herself? To me, it appears to be slutty. Im not the girls friend, I dont know her. But it doesnt give her a good image doing what she does.

She may come from a messed up home if she did something like this and may end up on drugs and prostiution. Yeah Im reading to much into this, but I can say what she has done is not clever or impressive.

Been on the Internet long? It ain't exactly a rare occurrence 'round these parts.

And also, she could have had a great home life, and still post nekkid photos on the 'net. Or end up on the streets.
