When a User registers to any online community, he agrees to the guidelines of that community in order to become a member. If the user gains enough infractions to deserve a ban, then the user will be banned regardless of what he or she says, unless he proves with facts and real evidence that he wasn't the cause of the problem, which is highly difficult on Internet, but not impossible.

Technically, he hadn't broken any forum rules until the duplicate accounts.
Thus earning a ban 
no, he needs to faaaaaaaaaaaaaaaak off and bother people on another forum. I strongly doubt he spends every waking moment of the day plotting how to get himself unbanned and/or bother us.
