I still don't see the difference. What possible difference could someone getting a copy of thatphoto make to what the guy could do with the photo? He would still have it... I'm not sure how being able to get a copy of it makes any difference to the situation at all.

What difference does it make? No one is harmed any by it. This focus on a persons intentions being the difference between a crime and a non crime is...well... insane, since it's almsot impossible to prove intent.
Either taking photos in public is legal, or its illegal. You can't change the law to "its illegal if he plans to use them for sexual gratification" because a) That doesn't change how it affects the person whose photo is being taken and b) can't be proved.
